Acceptance of Terms
Before you attempt to register with www.MyAuctionsInternational.com, Auctions International, Inc. requires that you read and accept the following User Agreement. Those who are under the age of 18, or who are not able to form legally binding contracts are prohibited from using www.MyAuctionsInternational.com (the Site). If you choose not to accept this agreement, you will not be allowed to place bids or list items on the website. For questions regarding this agreement, please contact our customer service department at 1-800-536-1401. This agreement is effective May 1st 2009 for current users, and upon acceptance for new Users.
Terms & Conditions
By checking the box next to the 'Submit Registration' button on the registration form, you agree and certify that you have read, understood, and accepted the terms and conditions of this User Agreement and all agreements incorporated by reference:
1) In order to obtain a membership to www.MyAuctionsInternational.com, users must register by filling out a registration form, and paying a non-refundable registration fee. Upon credit card approval of the registration fee, and submission of the registration form, such user shall become a ‘Registered User’. Users agree that such information shall be (and kept) current, complete and accurate. Auctions International reserves the right to disapprove, suspend or terminate User accounts for any reason, at it’s sole discretion, and prohibit such User(s) from participating in the Services.
2) During the registration process, Users will select a ‘Member ID’, and upon successful registration a randomly-generated password will be sent to the email address entered on the registration form. Users are solely responsible in all aspects for all use of the login information provided by Auctions International. Users agree to notify Auctions International immediately of any unauthorized use of any Member ID or password, or any other breach of security regarding the Site.
3) When a Seller lists an item or uses a service that has a fee the Seller has the opportunity to review and accept the fees that they will be charged. We may choose to temporarily change the fees for our services for promotional events (for example, free listing days) or new services, and such changes are effective when we post the temporary promotional event or new service on the Site. Unless otherwise stated, all fees are quoted in U.S. Dollars. You are responsible for paying all fees at the time item(s) are listed. If your payment method fails your item will not be listed and no fee will be charged.
4) When a seller lists an item on www.MyAuctionsInternational.com, and a buyer places a winning bid on that item, the seller and buyer enter into a contract that both members are expected to honor. For sellers, this contract includes both formal requirements, as well as informal, "common-sense" obligations to provide good service to their buyers. Sellers who create excessive bad buyer experiences may violate the Seller Performance policy.
5) Sellers are responsible for all content posted in a listing. All content is subject to review by Auctions International. Sale of vehicles, heavy equipment and these restricted items are not permitted on the Site. Sellers are not permitted under any circumstance to post content or items in an inappropriate category or areas on our site; violate any laws, third party rights, or posting of restricted items; post false, inaccurate, misleading, defamatory, or libelous content (including personal information); distribute viruses or any other technologies that may harm the interests or property of Auctions International or its users. Failure to comply will result in a warning, temporary suspension, account termination, listing cancellation, forfeit of fees on cancelled listings referral to law enforcement or any action that Auctions International Inc. deems necessary to ensure a secure and reliable trading environment on the Site.
6) Auctions International reserves the right to reject or void bids, whether winning or not, which it believes have not been made in good faith, or are intended to manipulate the auction process, or are prohibited by law. If Auctions International determines that a Seller or someone associated with the Seller has bid on that Seller’s own item, shill bidding penalties will be assessed against the Seller. Auctions International will cancel the involved transaction(s) and listing fees will not be refunded. The Seller will be subject to a warning, temporary suspension, or account termination or any action that Auctions International Inc. deems necessary to ensure a secure and reliable trading environment on the Site.
7) Once the system accepts your online bid, you have entered into a binding contract with the seller and are obligated to pay for your winning bid(s). By bidding, you are agreeing to be held personally liable for the bid amount, and any other fees or applicable taxes specified in the item description. Bidders agree that bidding on the Site is the legal equivalent of a firm purchase order. Auctions International, Inc. reserves the right, and you acknowledge and agree to its exercise of this right, to notify third parties, including law enforcement authorities, credit bureaus, other auction companies and industry regulators and authorities, about bidder's involved with or connected to fraudulent bidding or the failure to fully pay for items won in accordance with our terms and conditions.
8) All winning Bidders are required to pay for their purchases within Ten (10) days of the auctions end. Buyer non performance will not be tolerated, unless the seller has materially changed the item's description after you bid, a clear typographical error is made, or you cannot authenticate the seller's identity. Users who fail to pay for their bids within the designated time frame will be subject to a warning, temporary suspension, account termination, cancelation of all current bids or any action that Auctions International Inc. deems necessary to ensure a secure and reliable trading environment on the Site.
9) No warranty is made with respect to the accuracy of any information provided to bidders regarding auction items, given in either written or image form, and bidders should rely solely on their own investigation and/or research of the item they place bids on. Narrative descriptions and photographs provided in online auction listings are for bidder convenience only. We recommend that all potential bidders personally and physically inspect all auction merchandise, before bidding. You will not hold Auctions International Inc. responsible for other users' content, actions or inactions, or items they list. We are not involved in the actual transaction between buyers and sellers. We have no control over and do not guarantee the quality, safety or legality of items advertised, the truth or accuracy of users’ content or listings, the ability of sellers to sell items, the ability of buyers to pay for items, or that a buyer or seller will actually complete a transaction.
10) Whenever you buy or sell something, we ask that you leave Feedback about the transaction that reflects your experience with the buyer or seller. Over time, members of the MyAI community develop a Feedback Profile, or reputation, based on the comments and ratings left by other members. The Feedback Score is the most important piece of a user profile. It’s the number in parentheses next to a member’s user ID. Buyers are not allowed to threaten sellers with negative or neutral Feedback in order to extort goods or services not included in the original listing. Feedback manipulation where the Feedback’s primary value is to artificially enhance a reputation rather than provide commentary and ratings on genuine transactional experience will not be tolerated. These activities include but are not limited to; the recurrence of listings which are uncharacteristic of a reasonable business model and designed to purposefully generate artificial feedback; offering to sell, buy, barter, or give away Feedback; registering multiple accounts (or working with others) in order to exchange feedback to artificially increase your Feedback score. Sellers are not permitted to include in their listings or terms of sale any conditions that limit or restrict the buyer from leaving Feedback. Buyers and Sellers are not permitted to include links, profanity or other inappropriate or unrelated content within Feedback comments. Buyers and Sellers may not take any action that may undermine the feedback or ratings system.
11) Our website uses Dynamic Ending Times for online auctions. Online auction ending times will extend by one-minute intervals if bids are placed in the last minute before the scheduled auction ending time. The ending times of the auctions will keep extending by one-minute intervals as long as bidding continues. Once there is 59 seconds without any bidding, the auction will end.
12) We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We view protection of users' privacy as a very important community principle. Buyers and sellers may under no circumstance distribute or post spam, chain letters, or pyramid schemes or harvest or otherwise collect information about users, including email addresses, without their consent. These activities will result in termination of your account and current listings without refund.
13) Auctions International reserves the right to withdraw, cancel, or postpone any auction listing at our discretion, and Auctions International will have no liability to prospective bidders or Sellers as a result of any withdrawal, cancellation or postponement of any auction.
14) Without limiting other remedies, we may limit, suspend, or terminate our service and user accounts, prohibit access to our website, delay or remove hosted content, and take technical and legal steps to keep Users off the Site if we think they are creating problems, possible legal liabilities, or acting inconsistently with the letter or spirit of our policies, terms and conditions. We also reserve the right to cancel accounts that have been inactive for a long period of time.
15) All information contained on www.MyAuctionsInternational.com is the sole property of Auctions International, Inc., and protected by United States Copyright laws. No one shall copy, reproduce, modify, create derivative works from, distribute, or publicly display any content from the Site without the prior expressed written consent of Auctions International, Inc.
16) Auctions International does not make any warranties or representations of any kind or nature with respect to the property in the online auctions or it's value, and in no event shall they be responsible for correctness of description, mileage, hours, genuineness, attribution, provenance, authenticity, authorship, completeness, condition of the property or estimate of it's value. No statement (spoken or written) in our online auction listings, catalogs, at onsite auctions, or anywhere else shall be deemed such a warranty or representation, or any assumption of responsibility.
17) If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
18) Auctions International is not responsible and shall not be held liable for interruptions or loss of internet connectivity, user errors or software issues, system failures of the bidder, or their internet provider, or due to unforeseen acts of nature.
19) If any provision of this Agreement is held or determined to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

| Sellers are obligated to the following requirements: |
| A) Accurately describe the merchandise in an online auction listing including: condition, size and quality, B) Honor the original terms provided in each listing by accepting payment for an item at the end of an auction, C) Promptly ship the item with appropriate packaging once payment has been received (when applicable), D) Respond promptly and professionally to questions from the buyer. Seller non-performance will not be tolerated and is subject to a warning, temporary suspension, account termination, listing cancellation, forfeit of fees on cancelled listings, referral to law enforcement or any action that Auctions International Inc. deems necessary to ensure a secure and reliable trading environment on the Site. Sellers are also required to resolve all performance issues on accounts that are not in good standing before buying or selling with other accounts. Sellers who are not in good standing are not allowed to register new accounts, and may face suspension or account termination with no refund issued. |
